Hillary Ineligible for Secretary of State?
Eugene Volokh at the Volokh Conspiracy makes a very cogent case that Hillary Clinton (and Senator Chuck Hagel for Defense Secretary) are not eligible for appointment under Article 1 Section 6 of the Constitution, the emoluments clause. The section prohibits the appointment of sitting legislators to a civil office with an increased salary during their current term. I don't know who has standing to challenge such an appointment if issued. Given the constitutional restriction, such an appointment would speak volumes about respect for the constitution on the part of both the president-elect and the senate.

At this time, the US Supreme Court is determining whether to hear a case based on Obama's eligibility for President of US. The issue is his birth certificate, which he has yet to allow anyone to actually see, and has hired three lawyer teams to keep these type of law suits out of courts in all states.
Both are important - Hillary and Obama's inelibiblity.
